Michael Browers End User License Agreement\r

NOTICE TO USER: PLEASE READ THIS CONTRACT CAREFULLY.BY USING ALL OR ANY PORTION OF THE FONT SOFTWARE YOU SHALL ACCEPT ALL TERMS AND CONDITIONS OF THIS AGREEMENT. IF YOU DO NOT WISH TO BE BOUND BY THIS AGREEMENT, DO NOT ACCESS, USE OR DOWNLOAD THE FONT SOFTWARE. PLEASE READ ALL OF THE AGREEMENT BEFORE YOU AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS.\r

You hereby agree to the following user licensing terms:\r

1. Michael Browers Font Software is licensed for use on a maximum of 5 computers and any printer or output devices connected to those computers.\r

2. A multi-device site license upgrade shall be purchased for multiple device use beyond the maximum of 5 computers and any output device connected to such computers.\r

3. You are authorized to take a copy of the Font Software you have used for a particular file to a commercial printer or other service bureau, and such service bureau may use the Font Software to process your file. However, if such a service bureau does not have a valid font license, the service bureau shall delete Font Software upon completion of processing your file.\r

4. The contents of Michael Browers’ Font Software shall not be copied or duplicated in any form except for back-up purposes, as provided herein. Michael Browers’ Font Software or documentation shall not be rented, leased, sublicensed or lent to another person or entity, for any purpose, with exception to a commercial printer or other service bureau, as it was mentioned above, in paragraph 3.\r

5. You are authorized to embed the Font Software, or outlines of the Font Software, into your electronic documents.\r

6. The user of Michael Browers’ Font Software agrees to credit Michael Browers’ as the Copyright Owner of the Michael Browers’ Font Software and shall list the Font names, wherever and whenever design, production, or any other credits are shown.\r

7. You are authorized to create outline artworks based upon the Michael Browers’ Font Software for your personal or business use. However, any attempt to alter the Font, using any font development program, for the purpose of creating an alternative version of the Font is prohibited. Additionally, you are not allowed to commission or authorize any third party to modify any Michael Browers’ Font without prior written consent from Michael Browers.\r

8. You are strictly prohibited from the use of Michael Browers’ Font Software in the creation of alphabet-based products, including, but not limited to rubber stamp sets, rub-on letters, address numbers, stencils, vinyl lettering, alphabet punch sets, alphabet sticker sets, or any other such products. Similarly, Michael Browers’ icon or dingbat fonts cannot be resold in other products where the icons themselves are the primary focus of the end product. Any such use requires a special license agreement with Michael Browers.\r

9. Any violation of this agreement shall cause this license to be automatically terminated. In the event of termination you shall immediately return the Font Software package to Michael Browers and certify that no copy shall remain in your, or anyone else’s possession.\r

10. Michael Browers makes no warranties, expressed or implied, as to the merchantability, fitness for a particular purpose, or otherwise. Michael Browers shall in no event be liable for any direct, indirect, consequential, or incidental damages, including damages from loss of business profits, business interruption, loss of business information, arising out of the use or inability to use the product, as described herein.\r

11. This Agreement shall be governed by the laws of Minnesota applicable to contracts wholly entered and performable within such state. All disputes related to the Agreement shall be heard in the Circuit Court of the Scott County, Minnesota, U.S.A.\r
