1.The Licence Agreement subject\r

1.1.\r
This non-exclusive license grants the Licensee certain rights to use the Suitcase Type Foundry Font-Software (SCTF Font-Software) and is not an agreement for sale of the SCTF Font-Software or any portion of it. The digital files downloaded to the Licensees computer contain the SCTF Font-Software that is the intellectual property of and is owned by the SCTF. Except for Licensees right to use the SCTF Font-Software granted by this license, all other rights, title of the SCTF Font-Software, the SCTF related trademarks and trade names are owned and retained by the SCTF.\r

1.2.\r
The Licensee agrees that the SCTF Font-Software is the intellectual property of the SCTF.\r

1.3. \r
With purchasing, downloading and/or installing any SCTF Font-Software, the Licensee (or the Licensee on behalf of his employer) will agree with the terms of this License Agreement. This Agreement constitutes the complete agreement between the Licensee and the CSTF. If the Licensee does not agree to the terms he shall not permitted to install and/or use any SCTF Font-Software. \r

2.The font software installation\r

2.1.\r
The Licensee can install and use the SCTF Font-Software on up to five (5) computers at a single location. These computers can be connected to, and the SCTF Font-Software used with, any number of output devices, such as a laser printer, ink jet printer, an imagesetter, but the SCTF Font-Software may be downloaded to the memory (hard disk or RAM) of only one (1) output device for the purpose of having such font software remain resident in the output device. If the Licensee need to download the to more than one output device or install the SCTF Font-Software on more than five computers, the Licensee is required to purchase additional licenses. The Licensee must represent and warrant that licensee's encryption of the embedded SCTF Font-Software is secure enough to prevent any access or use by others. \r

2.2.\r
The Licensee can use the SCTF Font-Software described in paragraph one (1) only for number of workstations (computers) and output devices (printers) mentioned above, which belong to the Licensee.\r

2.3.\r
Provided the SCTF Font-Software is configured for a network use. The Licensee may install the SCTF Font-Software on a single file server for use on a single local area network for either, or (but not both) of the following purposes: \r

¥ permanent installation onto a hard disk or other storage device of up to five computers and one output device, \r

¥ use of the Font-Software over such network, provided that the number of different computers on which the Font-Software is used does not exceed five computers and one output device.\r

2.4.\r
The Licensee may install the SCTF Font-Software on one home or portable computer. However, the SCTF Font-Software may not be used on the secondary computer by another person at the same time the SCTF Font-Software on the primary computer is being used and contrary. \r
2.5.\r
Using the SCTF Font-Software on more than five computers and/or one output device as described above is only allowed if you have purchased the appropriate multi-user license.\r

3. Copy\r

3.1.\r
The Licensee may not copy the SCTF Font-Software onto more storage media than mentioned above, except for archival and/or backup purposes only, in which case the Licensee may make one copy and are required to copy all copyright and trademark notices incorporated in the data of the SCTF Font-Software and to mark such copy with the same labels, including any copyright and/or trademark notices, as to be found on the original media. \r

3.2.\r
The Licensee may take a copy of the font(s) only for the purpose of outputting particular files for a commercial printer or other service bureau, and only if such commercial printer or service bureau has informed the Licensee that it has purchased or has been granted a license to use the SCTF Font-Software. \r

3.3.\r
Other than the copy intended for commercial printer or the service bureau, the Licensee cannot provide copies of the fonts to be used by a third party even if the third party uses them for the Licensee or in the name of the Licensee. Only if the third party had informed the Licensee that the third party itself had bought a Licensees licence can the third party receive a copy of the fonts described in paragraph one (1) from the Licensee.\r

3.4.\r
Embedding of the SCTF Font-Software into electronic documents or internet pages is only permitted in a secured read-only mode. The Licensee must ensure that recipients of electronic documents or internet pages cannot extract the SCTF Font-Software from such documents or use the embedded SCTF Font-Software for editing purposes or for the creation of new documents.\r

4. Manipulation\r

4.1.\r
The SCTF Font-Software and all its components are protected by the law of copyright and remain the property of the SCTF.\r

4.2.\r
The SCTF Font-Software may be converted and installed into another format for use in other environments, subject only to the following conditions:\r

a computer on which the converted SCTF Font-Software is used or installed shall be considered as one of the Licensees permitted number of computers,\r

use of the converted SCTF Font-Software shall be pursuant to all the terms and conditions of this License Agreement, \r

such converted SCTF Font-Software may be used only for Licensees personal use exclusively and may not be distributed or transferred for any purpose.\r

4.3.\r
The Licensee may not modify or remove the name(s) of the SCTF Font-Software, author's signature, copyright and trademark notices from the all original files\r

4.4.\r
To make or to have made, or to give permission to make a derivative of the SCTF Font-Software or its components or a fonts which resembles the SCTF Font-Software or its components under any form is strictly prohibited. \r

5. Warranty\r

5.1.\r
The SCTF warrants that the SCTF Font-Software will perform in accordance with the specifications published by the SCTF for a period of ninety (90) days after delivery. The Licensee exclusive remedy and the sole liability of the SCTF in connection with the SCTF Font-Software is repair or replacement of its defective parts within the ninety (90) day period after delivery. The warranty does not apply to any SCTF Font-Software converted or modified by the Licensee.\r

5.2.\r
The SCTF does not any warrant the performance, results or saleability may obtain by using the SCTF Font-Software by the Licensee.\r

5.3.\r
The SCTF shall have no responsibility to replace the product or refund the purchase price to the Licensee if failure results from accident, abuse or misapplication, or if any product is lost or damaged due to theft, fire, or negligence.\r

5.4. \r
The SCTF shall in no event be liable to the licensed user or any other third party for any direct, indirect, consequential, or incidental damages (including damages from loss of business profits, business interruption, loss of business information and others) arising out of the use or inability to use the SCTF Font-Software even if the SCTF has been advised of the possibility of such damages.\r

5.5.\r
The Licensee shall indemnify and hold harmless of the SCTF from and against any claims or damage which may result from breach of this License Agreement by the Licensee. \r

6. The Licence Agreement termination\r

6.1.\r
After warranty period in the case where the Licensee does not comply with the clauses of this contract and/or breach any circumstances of this Licence Agreement, the SCTF has the right to immediately terminate this Licence Agreement without any financial compensations whatsoever.\r

6.2.\r
The Licensee will immediately have to turn over the SCTF Font-Software and all its components (media, copies and other parties) to the SCTF or destroy the SCTF Font-Software and all its components that the Licensee holds, prohibiting any further use. \r

6.3. \r
Upon termination the Licensee agrees to inform his employees or any other person having access to the SCTF Font-Software and copies thereof, of the terms and conditions of this SCTF Font-Software Licence Agreement and to ensure that they shall strictly abide by these terms and conditions.
