IF YOU DO NOT ACCEPT THE TERMS OF THIS LICENSE AGREEMENT, DO NOT MAKE ANY COPIES OF TILDE FONT SOFTWARE, AND INSTEAD, PROMPTLY RETURN THIS LICENSE TO YOUR POINT OF PURCHASE WITH A PROOF OF PAYMENT WITHIN 30 DAYS FOR A REFUND OF YOUR PURCHASE PRICE. INSTALLING TILDE FONT SOFTWARE OR MAKING A COPY OF IT CONSTITUTES ACCEPTANCE OF THE LICENSE AGREEMENT.\r

1. License Grant\r

In consideration of payment fee, which is a part of the price you paid for this Tilde Font Software, Tilde as Licenser grants you, the Licensee, a non-exclusive, non-assignable, non-transferable license to use this Tilde Font Software only subject to all of the terms and conditions of the Agreement. Tilde reserves all rights not expressly granted to the Licensee by this Agreement.\r

2. Ownership\r

This Tilde Font Software and other materials are licensed to you, the Licensee. As the Licensee, you own the media on which the Tilde Font Software is originally or subsequently recorded or fixed, but Tilde and/or its licensors retain title to and ownership in the Tilde Font Software recorded on the original copy and all the subsequent copies of it. This License is not a sale of the original Tilde Font Software product or any portion or copy of it.\r

3. Permitted Uses\r

As the Licensee, you may physically install and use Tilde Font Software on no more than five (5) personal computers at any given moment of time. If you have multiple Licenses for this Tilde Font Software, then at any time you may install and use Tilde Font Software on as many workstations as you have Licenses. You may not modify, adapt, translate, engineer, decompile, disassemble or create derivative works based on Tilde Font software. Written materials provided to you may not be modified, adapted, translated or used to create derivative works without the prior written consent of Tilde.\r

You may take a copy of Tilde Font Software used for a particular document, or Tilde Font Software embedded in an electronic document, to a commercial printer or service bureau for use by the printer or service of printing such a document but only if the printer or service bureau represents to you that it has purchased or been granted a license to use that particular Tilde Font Software.\r

You may distribute Tilde Font Software electronically embedded in a document only when Tilde Font Software embedded in such document (a) is transformed into a static graphic image (for example, a ìgifî) or an embedded electronic document, and (b) is distributed in a secure format that permits only the viewing and printing (and not the editing, altering, enhancing, or modifying) of such static graphic image or embedded document.\r

You may not alter Font Software for the purpose of adding any functionality which such Font Software did not have when delivered to you by Tilde. You may not change or alter the embedding bits which determine the capabilities of Tilde Font Software. Tilde Font Software may not be used to create or distribute any electronic document in which Tilde Font Software, or any part thereof, is embedded in a format that permits editing, alterations, enhancements, or modifications by the recipient of such a document.\r

4. Transfer\r

You may transfer all your rights to use Tilde Font Software to another person or legal entity provided that (a) the transferee accepts and agrees to be bound by all the terms and conditions of the Agreement and (b) you destroy all copies of the Font Software, including all copies stored in the memory of a hardware device.\r

5. Backup\r

You may make one back-up copy of Font Software for your own archival purposes only. Upon termination of the Agreement, you must destroy the original and any and all copies of Tilde Font Software.\r

6. Termination\r

This Agreement is effective until terminated. This Agreement will terminate automatically without notice from Tilde if you fail to comply with any provision contained herein. Upon termination you shall destroy the written materials, Tilde Font Software and all copies of them, in part and in whole.\r

7. Disclaimer and Limited Warranty\r

Tilde warrants to you that the Tilde Font Software will perform substantially in accordance with its documentation for the ninety (90) day period following delivery of the Font Software. To make a warranty claim, you must, within the ninety (90) day warranty period, return Tilde Font Software to the dealer of Tilde Font Software from which you obtained it along with a copy of your receipt or contact the on-line provider if Tilde Font Software was acquired on-line.\r

If Tilde Font Software does not perform substantially in accordance with its documentation, Tilde's entire liability and your exclusive remedy shall be limited to the refund of the purchase price you paid to obtain delivery of the Font Software. If the failure or dysfunction has resulted from an accident or misapplication, Tilde shall have no responsibility to replace the media or refund the purchase price.\r

Except as expressly provided above, Tilde Font Software package and other materials are provided \"as is.\" Tilde does not make any warranty of any kind, either expressed or implied, including, but not limited to the implied warranties of merchantability and fitness for a particular purpose.\r

Tilde shall not be liable for any direct, indirect and consequential or incidental damages (including damages from loss of business profit, business interruption, loss of business information, and the like) arising out of the use of Tilde Font Software even if Tilde has been advised of the possibility of such damages.\r

8. Governing Law\r

This Tilde Font Software License Agreement is governed by the laws of Latvia. If this product was acquired outside Latvia, then local laws may apply.\r
